Jan Posted October 17, 2016 Share Posted October 17, 2016 IMy PIP appeal is to be heard at Tribunal in Chester tomorrow, I am a little anxious (understatement) John is coming with me, we don't have a welfare rights person in our borough.Have any of you been through this rather daunting experience? Louise Posted October 17, 2016 Share Posted October 17, 2016 Hey Jan No not a tribunal put the daunting of filling in the forms and medical. welfare rights or citizen advice would do, I'm glad John is going with you same advice as going for the medical be honest about your worst days push the fatigue. Super Mario Posted October 17, 2016 Share Posted October 17, 2016 It is several years ago since I attended a tribunal but bear in mind the people on the panel (either 2 or 3 depending on whether it is for ESA or PIP) are completely independent of the DWP and are NOT little Hitlers. All you can do is answer their questions honestly and in depth, do not leave anything out regardless of how embarrassing it is. Jan Posted October 18, 2016 Author Share Posted October 18, 2016 Hi, Thank you all so much for your kind thoughts and encouragement, I am humbled by the support from you all. We have just got home now. Hearing started late, 3.35. The Panel consisted of the Judge, a Doctor and a Disability specialist. They asked lots of questions, always giving me time to answer and giving John and I the chance to ask questions They treated us-with the utmost respect. The Appeal was successful ??????I have been awarded the standard rate PIP. I'd much prefer to be working in my Sweet Shoppe, but this will help The other reason we are late getting home is John had.arranged for us to go to an Italian in the city centre, even had a naughty celebratory glass of vino! jan xx 6 Quote Link to comment Share on other sites More sharing options...

Jan Posted October 19, 2016 Author Share Posted October 19, 2016 I just wanted to add, for anyone who has to go through this in the future,I worried unnecessarily about the hearing, it was actually quite a relaxed atmosphere in the courtroom. Entering the building was quite bizarre, I hadn't realised the formalities and legalities of entering the building where the courts are so I was a little surprised to have my handbag searched, I had a small bottle of water with me and had to drink some in front of the security guards then walk through the metal detector/scanner. It beeped so it was then, arms up and handheld scanner sweeped up and down. I actually applied for a PIP in the summer as I finally heard back from the DVLA and have been given a 3 year restricted driving license and have to drive a hand controlled car. That along with the other difficulties I have around mobility as a result of the haemorrhage and spine damage led me to apply for it. I had the initial assessment at the end of summer with Atos Healthcare and was rejected for the PIP. I am currently appealing it, especially due to the number of errors in the medical report (the nurse had put that I work full time on one page, and then part time on another - amongst other things), however I do not know how it will go. Reading your post has been useful, however, so thank you for sharing. I have been fortunate as I have returned to my previous job, albeit in a reduced capacity as I now work part-time and also have quite a lot of adjustment at work such as having my own work-space and classroom and having my classes distributed so I do not teach any full days and get lots of breaks. I did feel, unfortunately that this did not work in my favour at all as the nurse seemed to feel that if I was able to do that then I couldn't be that bad (which is rather annoying considering the amount of effort it has taken to return to work). We shall see how the appeal goes however. I have had to sell my old car as it was a manual and cannot be turned into a hand-controlled car and obviously with going part time I have dropped in terms of salary, so at the moment a hand controlled car is not affordable.
